Copyright Office review of DMCA Safe Harbor could kill Fair Use

Big corporations are demanding the Copyright Office to review and revise or remove Section 512 of the Digital Millenium Copyright Act (DMCA) which protects websites from being trolled and bullied. Removing or revising Section 512 of the DMCA will eventually kill Fair Use and put an kick an ordinary citizen off the internet and be fined and sent to prison who posts videos of a dancing baby or keyboard playing cat with copyrighted music playing in the background, upload a fan work of a copyrighted anime, cartoon, movie or fictional work to websites like DeviantArt. dA would be forced to police, remove the fan art category, ban users who upload fan works or otherwise it would be the end of dA as we know it.

I might be moving soon

Turns out I might be moving soon.

A neighbor who was my landlord passed away and his sons are telling us to move out. It's not confirmed yet but the thing is that we had a contract with our landlord and it would cost $5000 to move our trailer.

We got nowhere else to go  The landlord's wife does the manages the payment but the thing is it's a breach of contract and the landlord's sons would have to find us a place to live.

I may not be on the internet for weeks.

Saban is NOT making Power Rangers exclusive to Netflix

Collider has falsely reported that Saban Brands is making Power Rangers including such new season adaptation of Shuriken Sentai Ninninger called Power Rangers Shuriken. Apparently that the worst title everyone has ever heard.

Collider is not an actual reliable resource but a mere satire parody like The Onion, National Report, Huzlers and Gawker.

Saban hasn't decide what they'll do with Power Rangers after they're contract with Nickelodeon expires. But a movie remake of Mighty Morphin, with just the title Power Rangers.

Saban has acquired Smile Precure as Netflix exclusive titled Glitter Force.

Make a Halloween costume for your kid, GO TO JAIL

Japanese people have been getting a false sense a relief by the Abe government that the TPP would not turn them into criminals if they cosplay.

A Japanese lawyer (according to Oshiete! Goo) can prove that cosplay is copyright infringement if you make one for a friend or sell one that your kid have outgrown in a garage sale or flea market.

Article 27 in Japanese copyright law that cosplay even Halloween costumes are for "personal and private use." But under the TPP, making cosplay and even an Halloween costume would make you a criminal even if it's for "personal or private use." Because under the IP chapter clearly states the penalties and procedures even extends to non-commercial use of the infringing material.

Did I forget to mention that reusing the same costume you bought from Party City or Walmart for yourself or a kid is a crime under the TPP?

Japanese Government lies about TPP, Cosplayers can still go to Jail

I just really can't see the way why Japanese people can still have false assurances from the Abe Government. Nikkei Asian Review reported that the Japanese Government is giving the people a false assurance that the IP chapter of the TPP would not affect Japanese culture, including cosplay. The last and latest leak still shows that Cosplayers can still go to jail. Heck even it would make Halloween including trick-or-treating a crime in the eyes of big corporations. Big corporations are taking away the happiness and imagination of children, and parents would be forced to tell their children they can't dress up this character or draw that character, or else the parents could end up in jail.

While kicking people off the internet through three strikes is not in this text as found in the other leak, TPP bribes ISPs to do so under the article it says that the ISP would be rewarded for cooperation to spy on users. Effectively, DeviantArt could soon be removing the fan art category, enforce their copyright policy and begin banning people from the site for posting fan art  DeviantArt could end up being shut down for good as it doesn't enforce copyright policy or complying to DMCA take downs sent by complainants.

And also the temporary storage part (which is a critical part to web browsers) that was removed has reappeared again in the final leaked text. Which still means that browsing the web can slap you a fine and send you to jail. Limitation and exceptions (which essential to Fair use) is only limited to trademarks and circumvention of devices (jailbreaking). While circumventing devices have been an exception for non-infringing use, it does not extend to geoblocking meaning the TPP establishes border patrol for the internet. Criminal penalties could put Libraries and Universities into legal danger as criminal procedures and penalties extends to non-profit. And to make matters worse, the IP chapter suggest it (if desire) establishes a kangaroo court international corporate tribunal meaning instead of getting tried in a normal criminal court in your own country, you get tried in a secret IP court where your 5th and 14th Amendment rights, Double jeopardy and to an attorney, are now dead.

Aside from this, another provision would force drug and other retail stores to pull all generic drugs from it shelves as it allows big pharmaceuticals to renew old drug patents, such as ibuprofen. The proposal was suppose to be 12 years but now the latest proposal has been reduced to 8 years, meaning the US caved in to accept 5 years but add an additional 3 years for biological data protection.

And another thing in this chapter it would arrest whistleblowers and criminalize journalism. It is a violation of the first Amendment, and the UN Human Rights Charter that covers freedom of speech. Amnesty international had spoke out against this. We really need to tell the UN that this trade agreement is a violation of our universal human rights.

The TPP is still facing a tough battle in Congress from some Republicans and most Democrats. The TPP would easily pass but then it wasn't the case as Senator Orrin Hatch said in a statement that the deal "falls woefully short" meaning that he would vote against the TPP.. Alabama Senators Shelby and Sessions who voted against Fast Track are likely to vote against the TPP because of a leaked Immigration chapter. Senator Session warned it would create an EU-style "Trans-Pacific Union". Senator Rand Paul also voted against the fast track.Senator Tom Tillis have also intend to vote against the TPP because of a safeguard that would protect our tobacco control laws (including age restriction that prevents lung cancer deaths in teens and adolescents) The rest are still undecided until the rest of text is released. it's unknown whether the environmental chapter have strong protections or remains the same as the previous leak. Whether a chapter on worker rights, or the issue of human trafficking was included as promised by Obama. The only thing that wasn't mentioned is currency manipulation.

Japan's Diet might still vote to ratify the TPP in April. But due to other things, including budget bills and the Upper House of Councilors elections that's about to come in the Summer of next year. Some members in Abe's ruling Liberal Democratic Party are coming against the TPP because of the protection of rice.

Latest leak reveals that the copyright term in the TPP has been set to Life of the Author plus 70 years.

This means an anime's copyright that was expired or about to expire prior to the 1960s.

ISP liability:  Requiring ISPs to kick users off the internet is no longer in the TPP. But the safe harbor provision of the DMCA in the TPP is restricted.

The TPP will go into force in 2018, two years after it's ratified by all 11 countries. However,  it will be difficult for Congress to pass it because.

- The ISDS safeguard was proposed by Obama, as praised by anti-tobacco advocates that prevents Big tobacco from suing countries who have current laws such as ID and age limit to purchase tobacco. Without this safe harbor, lung cancer in teens would skyrocket.

- 8 year drug data protection. Which falls short to the proposed 12 year, as found under US patent law. Senator Orrin Hatch, Chair of Finance Committee, would possibly vote against the deal.

- Immigration chapter as warned by Senator Pete Sessions of Alabama.

TPP ratification through Fast Track proceedure may fail

Passage of TPP could be a quick before Boehner resigns and leaves.

However, there is some good news that there may be a chance the ratification of TPP through Fast Track could fail on further issues.

1. Proposal on data exclusivity is now 8 years contradicting US patent law on biological medicines which is currently 12 years. Senator Orrin Hatch, President Pro-Tempore and Chair of the Senate Finance Committee recently said he would vote against the TPP if the wording that so contrary to the US patent law on biological drugs is not agreed to by negotiating countries. Even if the US caved in to Australia's  demands to have The US to rollback it's data exclusivity back to 5 years, which we are willing to live with that, it would still be voted against. TPP would be dead on the floor.

2. ISDS safeguard, that would prevent Big tobacco like Phillip Morris from suing countries like Australia, has been reintroduced by President Obama. It was recently proposed but was withdrawn. While it's some good news for anti-tobacco advocates, it's bad for pro-tobacco Republicans. Senate Majority Leader Mitch McConnell who is pro-Big Tobacco would likely introduce a disapproval resolution, which according to the provision in fast track trade authority requires 60 votes before revoking fast track, thus Republicans would be free to remove the safeguard except like in the normal treaty ratification process, it would require 67, thus it would be difficult to get some Democrats, who oppose the TPP, on board.

3. Immigration Chapter that was leaked as Senator Jeff Sessions warned it would undermine our sovereignty. He voted against Fast Track, so it's likely he would vote against the TPP.

4. It could be two votes short because Senators Cruz, Graham, Paul, and Rubio are in the 2016 presidential race, that unless Senator Joe Manchin, and another pro-trade democrat who supports free trade, or independent Angus King joins in adding the deciding vote by the Senate President, Vice President Joe Biden, who will likely give it a thumb up to pass it.

Update:

TPP is signed. However, I have said in my previous posts the provision in Fast Track that requires the president to release the text of a trade agreement only applies to future trade agreements. So even if it's blocked, the final text will never be released for another 4 years as reported by UK-owned The Independent as leaked. Despite of this, President Obama may have already signed the same day it was finalized, meaning it could be voted on in the house on the first week in December and in the Senate after the holiday recess.

Anime could soon in the near future die on its deathbed as an anime studio, Manglobe known for its' productions Samurai Champloo, Michiko and Hatchin, and Deadman Wonderland,  files for bankruptcy becoming insolvent.

It's current film Genocidal Organ is slated to premiere in Japanese cinemas on November 13th. It is unknown whether the film is finished or unfinished.

Editthis.info is down, and could be the end of the wiki

Editthis.info is down and could be the end of the site if it doesn't come back up in a day or so.

I may migrate to wikia if it's the end of Editthis.info.

It has "Error 2003". It is run of a MySQL server and I don't know if robkohr is going to fix it or not. Checked his Twitter page and he rarely post with no future on Editthis.info, just a bunch of YouTube videos. I have set up a new blog for fanfiction and original fiction.

Time to uninstall firefox immediately

I'm not joking. Due to complaints being sent to Mozilla, it's time to switch to another browser (ex. Edge, Chrome, Opera, etc.) and ditch Firefox immediately.

Here's why:

1. Site compatibility, ogg format is being ditched which is bad news for Wikipedia.

2. Developers are required to validate their add-ons. Meaning you will be exposed to more malware, cookie tracking, and Web of Trust that you have will go bye-bye.

3. Cut-Copy-Paste? Useless since they have been given into demands of big media corporates, big corporate publishers.

4. Your computer mouse might become useless in version 41 I don't know why MouseEvent.movementX/Y would be unprefixed.

5. Websites will also become inaccessible as HTTP/2 is being ditched.

Here's how to remove Firefox.

1. For Windows 10 users, Edge browser is pre-installed with the OS. It may have bugs in it, so you could use it if you want to. you can install Chrome, or Opera as well.

2. Once you have installed the alternative browser you selected go to this link and follow the instructions to uninstall firefox.

3. Once you done it. CONGRATULATIONS, YOU ARE FIREFOX-FREE!!! :)

The TPP is not grinding to a halt, it's close to being finalized and signed

Regardless what Techdirt wrote that TPP is grinding to a halt, the title of the article is putting us off-guard. As for me, I'm always vigilant for what's coming as Malaysia Mustapa and Japan's Amari have both announced that they're making progress and about to set a date for a ministerial meeting to finalize the TPP.

And when that date comes, the TPP will soon be finalized and signed at the end of the meeting before the Canadian elections and could be passed by Congress immediately before the Presidential election with no chance of revealing what's in it for the next 4 years and like I said in my last post Fast Track only applies to future trade agreements.

Thinking that the TPP coming to a halt is putting us off-guard as negotiators were secretly negotiating the TPP over the phone.

Another issue that the TPP would prevent the Copyright Office from limiting statutory damages for works that aren't registered. It's called Orphan works.

Under the US Copyright office's proposal, works that have been created without being registered, just a reminder for those who want to use someone else's work who have to check the database if the creator of the work is found or not. Statutory damage of the infringement of the creator's work that is unregistered would be limited or nullified means that the work whom the creator made it, the infringer now owns it. But under the TPP,  statutory damages for the infringed work is $150,000. Sounds good for the creators who uploads their created work to DeviantArt would want it, now do they?

Update: It is now confirmed that the conclusion of the TPP reported by Trade Representative Jack Lew is under way.

Update 2: The Final Ministerial Meeting has been set from September 26-30. Despite resources saying about Obama having trouble getting the TPP passed in Congress is just not accurate. Again, The TPP will be passed quickly and the provision in Fast Track that requires the President to make trade agreements available to the public within 60 days before signature only applies to future trade agreements

Fast Track Trade Authority only applies to future trade agreements

According to the Fast track 2015, once a trade agreement is finalized, the president must publish the finalized trade agreement within 60 days. Unfortunately, this might not be the case as it could only apply to future trade agreements, and may not apply to the TPP, keeping the full text hidden for the next few years as Australian Trade Minister Robb announced to the Australian (Subscription only) that the trade agreement will be signed within weeks after the deal is concluded, which could be up into the end of next month. Congress will then within 60 days from both houses must approve the agreement with changes to its laws.

Time to kill Flash player, no seriously

Even with more new patches, hackers can still exploit the software. So as Facebook Security just told Adobe to finally sunset Flash Player. They're not suggesting to kill it overnight, Adobe hasn't announced a sunset date for it.  In 2011,  Adobe announced to switch to HTML5 for mobiles. When Adobe announces a sunset date, game developers are going to soon adopt HTML5 before it shuts down. That means no more updates. Flash games will be in the dust, Zynga will soon have to kill off its flash games and put focus on mobile games.

Current PCs that run Windows 7 will need to upgrade to windows 10.

As for XP and Vista, HTML5 videos will work on some videos like YouTube (I did a test, worked fine on some videos but other videos require hardware upgrade, that is buying a new laptop or tablet). But with flash being ditched, the ball in Mozilla's court will decide the fate of its support for XP and Vista for it future versions of Firefox including its project Shumway that converts Flash animation to HTML5, which really needs to push forward pulling it out of its nighttime testing and putting it into the next version and thus like I said Mozilla will soon announce that its next version and other future versions will stop supporting XP and Vista, and supports version 7, 8.1 and the upcoming version 10 within a couple of weeks.

 Heroes of the Realm is shutting down because of lack of players and very little funds to update the game.

Funimation's statement puts Fan Artists in its legal crosshairs

Since the passage of Fast Track Trade Authority,  Funimation has released a statement regarding fan art at anime cons and online.

The statement reads as follows

FUNimation's Stance1 On Fan Art
At law, a fan-created artwork that is clearly based on existing artwork owned by a copyright holder other than the fan (e.g. FUNimation), is considered an unauthorized "derivative work" or an unauthorized reproduction (by substantial similarity) and therefore infringes the copyright holder's rights under 17 U.S.C. § 106. 

Despite FUNimation's legal stance on this issue, FUNimation appreciates the entertainment, education and skill that goes into and arises from the imitation and creation of works derived from existing works of popular manga and anime. FUNimation likewise realizes that the "Artist Alley" area of most conventions can be a good showcase for these works and therefore FUNimation tends not to enforce its copyright rights against those in Artist Alley who may be infringing FUNimation's copyright rights. 

FUNimation's trademark rights, on the other hand, cannot go unenforced. This stems from a key distinction between U.S. Copyright Law and U.S. Trademark Law-in short, if copyright rights are not enforced, the copyright stays intact and the copyright holder generally will not suffer any harm beyond the infringement itself. But if trademark rights are not enforced, the trademark can be cancelled. Because of this difference, FUNimation cannot knowingly tolerate unauthorized use of its trademarks, such as use of trademarks in conjunction with the display or sale of works whose creation is likewise unauthorized. This means that FUNimation will take action if it or its agents discover unauthorized works, including fan art, which include a FUNimation-owned/licensed trademark within the work or are on display in conjunction with signage bearing a FUNimation-owned/licensed trademark. Note that the trademarks FUNimation is primarily concerned with are brand names and logos. 

As to the Dealer's Room, FUNimation strictly enforces both its copyright rights and trademark rights, almost without exception. This applies to works that are believed to be counterfeit, unlicensed or fan-created. 


What this means for fan artists is that they can no longer post fan art of Funimation's licensed properties online (DeviantArt, Flickr, Etsy, Zerochan, Pixiv, Pinterest, etc.) even if they're not making a profit according to the third paragraph of this statement.

This isn't Funimation's decision. They had no choice because they could risk losing their licensing rights if they refuse to crack down  against fan art on behalf of the anime studios (Toei, Shin-Ei Douga, etc.).

Because of this Japan likely changed it's copyright law to meet the requirements of Trans-Pacific Partnership including copyright terms.

So even if the fan art doesn't contain logo of the company or of the titles of it's licensed properties, fan artists could still be in legal trouble just as they would get into trouble with Disney for drawing Mickey Mouse.

Latest and final leak of TPP could force stores to pull generics off shelves and kill affordable health care

This is the latest and final leak of TPP in the IP chapter on drug patents which contains a provision that would force all retailers to pull all generic drugs off the shelves. Why would Obama want to do that? He wants to let people die off from treatable diseases including HIV/AIDS. Schools will not be able to afford vaccinations. This is nothing but profits over health and there's nothing we can do about it with the passage of Fast Track.

RIP Freedom. Fast Track passes 219-211

it's over. fast track has passed by 219-211.

Update:  The first half of the Trade bill was blocked.  Which has slowed down Fast Track. The other half was passed, meaning the vote was symbolic. Both pieces (Fast Track and TAA, a program that compensates workers for lost jobs being sent overseas that is about to expire in September) have to be passed at the same time as a whole before the president signs it. Without TAA, the Senate can't pass Fast track alone.

House Democratic Leader Pelosi wants to vote to renew the Highway Trust Fund, but she seems to forget that the Medicare cuts provision must be removed from the TAA half of the trade bill and if TAA gets blocked the second time, and if House Democrats refused to go to conference, then the whole trade bill is dead.

Contact your Representatives and vote no on TAA so we can defeat Fast Track.

UPDATE: Boehner and Ryan bribes Democrats with increased tax penalties on small businesses that most Republicans oppose. This will unlikely change most Republican no votes to ayes. And if, say at least 65 of the 84 republicans that voted for TAA is changed to NO, this will only continue to delay for a short time if both House and Senate goes to conference (a conference resolution must be passed in both Houses) and if Senate democrats filibuster a conference resolution, then Fast track is dead, that is unless the Senate could amend a new TAA to half of the trade package that is passed, it would be impossible to stop fast track.

UPDATE 2: We'll I'll see you all in prison as TPP goes into full effect. Obama has reversed his decision and will sign Fast Track without TAA.

How ridiculous polls show that Americans don't care about sovereignty and other things

While Fast track is not expected to be brought to the floor to be voted on this week according to House Majority Leader Kevin McCarthy, polls shows that a majority of Americans support fast track, TPP and TTIP.

Pew Research poll shows 58 percent support free trade

Reuters poll shows 56 of Americans support free trade.

That's right 56-58 percent of Americans support:

* giving up jobs and sending them overseas for free welfare.

* poisoning our drinking water

* eating poisoned food.

* killing off our bees with GMOs

* treating the educational use of published works in universities as a criminal IP infringement.

*  Letting people die of AIDS by making drugs expensive and pulling generics off the store shelves.

*  letting little children have lung cancer by repealing our anti-smoking laws allowing minors to purchase cigarettes, even e-cigs.

*  lowering our federal minimum wage to 25 cents.per hour.

Majority of Americans support free trade for free welfare and killing humanity.

TBN just announced they are launching a new network targeting English speaking Latinos called TBN Salsa. According to Multichannel, they are combining JUCE TV and Smile of a Child TV meaning that Smile of a Child is likely to close down on June 1.

No more Little Women. No more Swiss Family Robinson.

Darn you TBN.

UPDATE: Smile of child will be sharing it's subchannel space with JUCE TV on subchannel .3  from 6am-3PM. But that still means as above.

UPDATE2: It appears that the Smile of Child and JUCE TV sharing subchannel .3 will not affect viewing over-the-top and online.

It's over: The House has enough votes to pass fast track

Our opposition against fast track has been defeated. Today, House Representative Paul Ryan has said on CNN's State of the union that they have enough votes to pass fast track.

It's over folks. Anyone who posts fan art and fan fiction are now criminals under the TPP, even there will likely a federal law to ban cosplaying, . American Taxpayers are going to suffer more under the ISDS chapter where not fair use and educational research, the rights of the deaf, blind, mute access to online resources are now in jeopardy, where environmental rules on fracking, clean water and clean air are being tossed out as corporations claims that it hurts profits, food safety and health are now gone down the drain. Phillip Morris sued Australia for tobacco labels,  Ely Lily sued Canada for infringing drug patents, this means that all generic drugs could be pulled off our store shelves and consumers will be forced to buy expensive drugs, TTIP can also repeal the ban on horse slaughtering. The UN Human Rights Council warned that these trade agreements are bad.


Facebook, Twitter, and Google are praising this they want to monitor and ban people for posting links to news articles. DeviantArt will soon likely remove the fan art category once fast track is passed for TPP.


Update: Bloomberg reports that it has 200 republicans and 25 democrats to pass this bill.

Closed Walmart Stores are not being used as detention centers, closures due to labor and online sales

Conspiracy theories about Walmart's closures of stores being used as detention centers for Americans cited by Infowars, Drudge Report, and BeforeItNews is nothing but a bunch of pure garbage, just as someone silly claims that some political boogeyman would establish a one world government and kill all who oppose his authority.

This on the other hand is that Walmart closures maybe due to labor unions striking for raising minimum wage, which is a possibility while Walmart claims that their store closures due to plumbing. But the real possibility I think and it's likely happening is that online sales are more favorable than retail sales.  Walmart recently set up its' online redistribution center where the consumer can do two things: Drive thru, order, and pick up goods (including groceries), or order online and have them delivered to their house.

Technology is overcoming the brick and mortar retail.

How a Deceptive Manga promotes Japanese Revisionism

This manga that the Fascist Shintoist Neo-imperialist right-wing Liberal Democratic Party are trying to take Japan back to the days of the Meiji era and whitewash their dark past by revising the 1947 Japanese Constitution, U.S General Douglas MacArthur had presented. To do this, the LDP has to win more seats in the upper house elections to get 2/3 of majority, which will soon likely spell an end to anime and manga in America as we know it, if Hillary Clinton or Bernie Sanders won the 2016 presidency and decided to make the possession of anime and manga a treasonous offense because of Japan's past atrocities they have committed including women from our neighbor Australia who have been coerced into sex slavery along with the Chinese, Malaysian, Filipino, Korean, and the natives of Guam, not to mention the torture and people being tested as guinea pigs in Unit 731, and the possession of biological weapons..

The 2012 draft is the same as Japan's Meiji Constitution.

Zynga will soon likely to close itself down as it closes down 10 games.

There is now a speculation that Zynga is soon likely to be closing itself down as it closes down 10 games. Farmville is not on the list. 4 of the 10 are included:.

Cityville
Castleville
Chefville
 Ninja Kingdom

Currently, it's stock(NASDAQ: ZNGA)  it's at $2.44 and the company is facing lawsuits it will sure likely face liquidation ending the company soon.

Hatch, Ryan, Wyden Fast Track Bill is the same old thing as the last

There's nothing new about this Fast Track legislation that has been introduced. These provisions in this bill is the same as the last one.

Apparently, President Obama and US Trade Representative Froman has lied that the trade agreements would not effect laws including Environmental, Labor, Health.

if changes in existing laws or new statutory authority are required to implement such trade agreement or agreements, only such provisions as are strictly necessary or appropriate to implement such trade agreement or agreements, either repealing or amending existing laws or providing new statutory authority.

 This means the minimum age to purchase cigarates, cigars, or alcohol would be repealed as well as the Clean Air Act and Clean Water Act. Even the cigarette, alcohol and Nutrition labels would be removed. Phillip Morris, tobacco corporation sued Australia for putting warning labels on cigarettes, costing them millions of dollars in damages.
 

According to Independent Senator Bernie Sanders, Vietnam's minimum wage is 25 cents per hour that's about 5397.5 Vietnamese Dong (VND) (1 USD = 21590 VND). So like what Sanders said, the minimum wage could drastically be lowed to $.25 per hour.

While the Environmental Goods Agreements do meet the objectives mainly the environmental part, other trade agreements, TPP, T-TIP, and TISA does not and currently there is not enough votes to revoke Fast Track. Under the new provisions of Fast Track, a committee must present a resolution of disapproval if a trade agreement does not the objectives and it requires 3/5 of the majority in both houses to revoke Fast Track, thus allowing Congress to pick apart a trade agreement.

The objectives regarding to environment, labor, and health, could be struck out by an amendment. Even if they weren't removed, it would be difficult for Congress to revoke Fast Track and pick apart trade agreements.

So far the Senate has enough to pass it. Now this will come right down to the House. Some Republicans are joining Democrats to block Fast Track. Sources say it could be up to 60 meaning 40 Democrats are needed to pass. So far 15 of them (Blue Dog and New Democrat Coalition which are DINOS) are supporting Fast track which is short.


So please tell your Representative to vote NO on Fast Track or our internet freedoms will be gone forever.

Mozilla may soon ditch Windows XP thanks to Project Shumway

Project Shumway is Mozilla's latest new feature that let you play flash games or videos on Dailymotion without the need of Flash Player, putting Adobe Flash to rest. Unfortunately, HTML5 like Shumway requires new hardware including a new graphics video card for desktop PCs and laptops which puts the final nail in the coffin for Windows XP.  Windows XP had a good long run, even after the April 14, 2014 end support and so did Adobe Flash, too.

But for Linux users, you could get a graphics video card but some articles say that the decoders will not be available for Linux, Ubuntu. Bye bye Linux.

RIP Spock, Leonard Nimoy died at 84

This is sad news for Star Trek fans. Leonard Nimoy who cast as Spock died at the age of 84. He also had played part as a guest appearance on The Simpsons.

Go to prison for Cosplay and Fan works? Akamatsu speaks out about TPP's copyright issues

It's isn't the file sharing that can put you in prison. It's also parodying, Youtube Poops, AMVs, cosplay, and fanworks that can put you into prison under the TPP.

An 18 year-old dresses up as Sailor Moon goes to Comic Con, Momocon, Big Apple Con, Sakuracon, or Comiket, and police officers approaches her and taking her away in cuffs because cosplay is punishable by a harsh amount of fines and even imprisonment under the TPP's IP chapter.

An 8-year old doodling SpongeBob SquarePants, and the FBI busts down the door and takes a poor child to prison to be raped by sex offenders because he is infringing Viacom's property even if it not done on the internet.All it takes is one fan drawing and under the TPP IP chapter you go to prison for life and your property will be confiscated even if such acts are not done on yours or your parents computer.

Ken Akamatsu creator of Love Hina says that Comiket won't be in danger right away. He implies it would take a year to change Japan's copyright law. But I don't think that's the case because the LDP/NK coalition has 2/3 of the upper house to override the lower house even if the DPJ controls the lower house.

The US is forcing Japan and Canada to cave in to expand the Mickey Mouse Act, which is life of the author plus 70 years, across the Pacific.

There is no word whether Senate Finance Committee Chair Orrin Hatch and Ranking Chair Ron Wyden have agreed on Introducing a fast track trade authority. However the only thing the President will threaten to veto if it contain a currency provision to stop cheaters from manipulating currency.

In the House, Democrats are going to vote against Fast track and some Republicans are joining in as well because the President has overused his Executive power on Immigration. But we don't know if it's going to be enough to stop Fast track from passing the House. And it will take 41 Democrats to block their version from passing. Fast Track requires 60 votes to pass.

While in 1998, Fast track failed in the House 243-180. 2/3 of the House is required to suspend the rules before a final vote which requires a simple majority to pass.

Toonami gets cut again, may soon get cancelled

With internet video through over-the-top like Roku and Amazon Fire, and tablets, smart TVs and Cable companies becoming IPTV internet video providers. Toonami is getting cut with all the reruns gone so that there will be just premieres. It's not official that DeMarco hasn't ruled out of cancelling Toonami again. We will wait see as it progresses.

RIP RadioShack?

Brick and Mortar, yes. But RadioShack's brand, no.

RadioShack may soon become an online retailer,  as polls from online news outlets shows that more people buy stuff online than their old fashioned brick and mortar. Walmart some time ago, starting it's own pick-up/delivery service where you buy groceries online and you can either pick them up or Walmart can deliver them to you.

Radio Shack has filed a Chapter 11 bankruptcy in order to sell it off.  Guess who? Amazon and Sprint.

Amazon, an online retailer has opened up its' first store, like Walmart, people can now pick up the things they buy online. Soon the company, will be setting up its pick-up service at old Radio Shack locations.

Meanwhile, Sprint a wireless company, has made an agreement with Radio Shack to share it's stores.

Adobe Flash is dead. But HTML5 still has the evil DRM

With YouTube ditching Flash for HTML5 is a bummer for two things.

1. You would need to buy a new laptop or a tablet which is expensive because it requires new hardware.

2. HTML5 has the dreaded DRM known as Encrypted Media Extensions (EME), thus forcing you to cough up more money to pay to watch your shows and movies, listen to music or read a news article and it will likely filter fan art and fan fiction derivative works. Movies, musicians, artists, and publishers all want in with the HTML5 because of DRM's EME.

Flash is dead, but not at least. Still it will continue to be supported for games on Newgrounds and Facebook for a little while. Zynga has no announcement that if it would ditch Flash for HTML5. In fact, 3 years ago Facebook urged game developers to ditch Flash for HTML5 but overtime it's a slow start.

HTML5 is a flash killer, and it kills internet freedom.

Toonami might soon be getting cancelled again as it's block loses 1 hour

There is speculation that Toonami may soon be getting cancelled again as it loses 1 hour. This is because that TV is dead and the internet has become a boon for online video services like Amazon Prime, Crunchyroll,  Hulu, and Netflix. Cable providers will soon be selling their Over-the-Top (OTT) services to customers as the FCC will soon vote on the final rule of the definition of a Multichannel Video Provider Distribution (MVPD) and also the incentive auction for the upper UHF broadcast band and AWS bands that will soon begin next year.

How Copyright Maximalism kills transparency: The Death of Chilling Effects Clearinghouse

Search and image results that get removed let's say links to fan works on DeviantArt usually ends up on Chilling Effects Clearinghouse. But now it's seems that IP maximalists have killed transparency using the "take down, ask questions later"  procedure. So now Chilling Effects is all but dead, it won't be long until the site shut itself down after being threatened by corporate copyright maximalists

So we are screwed until DeviantArt becomes the next victim to be forced to remove all the fan art and even the fan art category from the site.
